Oceanfront Residential: Development and Strategic Lot Redivision
Creative resolution of historic septic limitations through enhanced soils testing and Land Court redivision
Comprehensive permitting before Board of Health, Planning Board, and Conservation Commission
Legal representation from land use and resource protection strategies through lot redivision and permitting
Project Vision
Located on a prominent stretch of coastline, the client sought to unlock the development potential of two historic oceanfront parcels encumbered by private septic limitations dating back to the 1970s. The goal: obtain permits to support construction of a signature residence with unobstructed views of Hingham Harbor and World’s End, while also creating and monetizing a separate buildable lot.
Legal Strategy
DTM Law Attorneys Jeff Tocchio and Scott Golding guided the property owner through a complex Land Court redivision to reconfigure lot lines and resolve legacy title and septic issues. The firm coordinated closely with engineers and environmental consultants to structure a path forward that met contemporary septic, conservation, and planning standards.
The project required successful navigation of multi-agency approvals, including the Hingham Board of Health, Planning Board, and Conservation Commission. DTM Law devised and executed a tailored land use strategy that preserved the coastal character while maximizing the property’s utility and value.
Outcome
The project resulted in the creation of a striking, custom-built residence with sweeping oceanfront views, along with the creation of a surplus waterfront lot—later sold for $8 million. The outcome highlights DTM Law’s ability to combine strategic land planning with comprehensive permitting and transactional execution to achieve exceptional client results.
